racehive: Licensee Agreement

Please read carefully as acceptance of these terms indicates a legal agreement between Krause IT-Consulting ("Krause IT-Consulting", "us", "we" or "our") and you ("User", "you" or "your").
To licence an image from racehive.co.uk, you must first check the box, “I understand and accept how this image can be used” on the image order page. At this point, you are explicitly agreeing to the terms of this agreement.

1. Your Licence

When you buy an image from racehive, you will receive a non-exclusive licence to use this photo for the full period of copyright.
You are not permitted to modify the photo, or ask someone else to do this.
You will not use the image for any other purpose – commercial or otherwise - unless expressly agreed with the copyright owner.
All images on the racehive website are watermarked and displayed in low resolution. Following payment, you will be emailed a link to a download in your racehive account in the resolution you have purchased.
All of your photos will be available for download for at least 28 days following purchase. Please make sure you have downloaded them by this time. Racehive will not be held liable for any requests made after this time.

2. Intellectual Property

You can purchase the licence for a photo through racehive, but will not automatically receive intellectual property rights: the person who uploaded the image owns intellectual property. Racehive is responsible to sub-licence this image according to the terms in our user agreement. As such, the owner of intellectual property will take any necessary proceedings if you are suspected to be in breach of copyright or intellectual property laws.
Racehive, in turn, reserves the right to delete your account and any associated images if this is found to be the case.

3. Your Authority

You are authorised to enter into this agreement and agree to the terms herein. You will not use these licensed rights to make the image defamatory, or to breach a third party’s privacy or other rights in any way.

4. Racehive’s Authority

Racehive undertakes and warrants that it is authorised to enter into this agreement.
Our user agreement prohibits the upload of photos if the user does not own, or have explicit agreement to exploit, their intellectual property. All photos displayed on the racehive website are, therefore, displayed in good faith that the user has kept to these terms. If we find a user in breach of these terms, photos will be removed immediately.

5. Liability Limitation

Before you buy a licence fee, you must be sure that the image meets your requirements. Refunds are not allowed in accordance with The Consumer Protection (Distance Selling) Regulations 2000, which exempts the purchase of an image from the statutory seven day cooling off / refund period.
Furthermore, racehive will not be liable for any damage, loss, expenses or costs arising from you entering into this agreement.
We scan our systems regularly but can’t guarantee that our photos will not contain viruses, nor can we accept liability for any found. We recommend that you scan all images on download to avoid any risk.

6. Payments and Pricing

The price shown on the racehive website is what you must pay for the licence fee. This includes our commission and transaction fees for our payment provider. Your payment will be taken as required by our payment provider. Once payment is authorised, we will send you a link to the image download.

7. Indemnity

By using racehive, you are not classified as one of our employees, freelancers or subcontractors. As such, you are not eligible for insurance or similar help from our site or company.

8. Termination

Either party can terminate this agreement if its requirements are not met.
You can close down your account at any time by request via email to support@racehive.co.uk.

9. Use of Photos

You may store the image on your mobile phone or computer; distribute for non-commercial use via email; add to personal websites and social media accounts; and/or print and display for personal use.
Commercial use is prohibited without express permission. If you want to use the photo for commercial purposes, please contact the intellectual property owner direct to negotiate a fee.

10. Miscellaneous

Through agreeing with these terms, you confirm that you are entering into this agreement entirely on your own behalf.
Any racehive users who upload images have the right to enforce any of the terms laid out in this agreement.
Racehive can assign or licence our rights under this agreement to a third party without providing notice.
The terms of this agreement are governed by and interpreted in accordance with the Laws of England. Disputes arising will be settled within the jurisdiction of the Courts of England and Wales.
